Press Statement on Court Hearing in Case Number 655866/2023, VLAS vs VMSL and the Government of Vanuatu

Vanuatu Logistics and Administrative Services Limited (VLAS) issues this press statement to provide the public with an update on the ongoing legal matter involving the Government of Vanuatu and Vanuatu Maritime Services Limited (VMSL).
During the recent proceedings in New York, the Court heard VLAS’s application for preliminary relief, which included the turnover of the Vanuatu International Shipping Registry to VLAS, as stated in VLAS’s valid and binding contract with the Government. However, the Court noted that any harm caused by the Government’s refusal to honor its contracts and VMSL’s interference could be adequately compensated through monetary damages. As a result, the Court was constrained to deny our application.
Nevertheless, it is important to note that this case is far from over.
The government and VMSL have indicated their intent to invoke Sovereign Immunity in an attempt to dismiss or delay the legal process. We will vigorously oppose any such application and fight against all attempts to cause delay. In the meantime, the case will proceed, and we are confident that once the Court delves into the substantive issues pertaining to the contract, as well as the conduct and responsibility of each party involved, justice will prevail.
It is disheartening to witness the Government and VMSL prolonging the case, as every day of delay simply amounts to increased financial damages for which the Government and VMSL will be liable. Furthermore, the behavior of these Defendants threatens the reputation of the Registry and of Vanuatu itself. However, we understand that this is just the initial stage of a process that will ultimately restore our rights. We firmly hold the conviction that good will triumph over evil.
Over the past two years, VLAS has demonstrated exceptional patience, and we remain ready, willing, and able to assume the responsibilities of Maritime Administrator for the Vanuatu International Shipping Registry. VLAS is determined to pursue the case till the end to defend its undeniable and non-negotiable rights.
Our primary objective is to reclaim the Shipping Registry and transform it into a valuable national asset. We are committed to operating with complete transparency and combating corruption, which deprives the people of Vanuatu of much-needed funds.
We express our gratitude to those who have shown continued support and understanding throughout this challenging ordeal. We remain steadfast in our pursuit of justice and our unwavering commitment to the nation of Vanuatu.
